The indictment further claims that LaGrone, during the commission of the assault, specifically used or exhibited a deadly weapon—a firearm.
In Texas, any offense against a police officer that causes serious physical harm is classified as a first-degree felony, meaning LaGrone may spend up to life in prison if found guilty.
However, a plea agreement has been made available to the 29-year-old, whereby he would consent to admit guilt in return for a 25-year prison sentence.
On Thursday, Brockway's husband showed up for a motion hearing in the case at Tarrant County District Court in Fort Worth, Texas, but she did not present.
